Please read these Terms and Conditions carefully before using the informational and commercial services provided on the COOPERATIVE ZASHTITNICITE internet pages, including the website zashtitnicite.bg (hereinafter referred to as "Services").

This document contains information regarding the General Terms and Conditions of use for the services provided by COOPERATIVE ZASHTITNICITE and regulates the relationship between us and each user of the COOPERATIVE ZASHTITNICITE websites, hereinafter referred to as the "Cooperative."

Agreement with the provisions below within these Terms and Conditions is a necessary and mandatory prerequisite for the use of the Cooperative by the User. Every User who has agreed to the general terms and conditions of the Cooperative is obligated to comply with them.

Definitions

Under these Terms and Conditions, the listed terms shall have the following meanings:

  1. "User" means any natural person who uses any of the services on any of the websites (internet pages) of the Cooperative.
  2. "Service/s" on the Cooperative's websites include:
    • access to informational resources and data provided via a web browser on the websites;
    • participation in the website forums;
    • the creation of User Profiles through registration on any of the Cooperative's websites, where registration is required to use specific website functionalities, such as: participation in games, including those for the purpose of receiving monetary or material prizes;
    • receiving email newsletters by registered Users of the website.
  3. "Partner" is any entity with which the Cooperative is in a contractual relationship and which has the right to provide additional information regarding its products or services to the registered Users of the website.
  4. "Malicious Behavior" (or "Bad Faith Behavior") represents actions or omissions by third parties that violate generally accepted ethical standards, including, but not limited to, DoS (Denial of Service – server overloading), server hacking, defacement, data theft, etc.
  5. "Direct Marketing" – the offering of goods and services to Users via mail, telephone, or other direct methods, as well as conducting surveys to gather opinions regarding the offered products and services.
  6. "Illegal Content" – any information which, in itself or in relation to a specific activity, is contrary to the applicable legislation of the Republic of Bulgaria or the legislation of any Member State of the European Union.

I. Parties, Subject, and Scope of the Terms and Conditions

  1. These Terms and Conditions constitute a legally binding contract between You and the Cooperative, which grants You the right to use the services available on the zashtitnicite.bg website solely for personal and non-commercial purposes, provided that you comply with the conditions set forth below. These Terms and Conditions shall have a binding effect only in the relationship between You as a User of the services on the Cooperative's website. By accessing the zashtitnicite.bg website, You agree to these Terms and Conditions and their subsequent amendments, and you undertake to comply with them. If you do not agree with any of the provisions below, please do not use the zashtitnicite.bg website of the Cooperative.
  2. If rules and/or terms of use on the part of the User for one or more functionalities of the respective website are published on any of the websites owned by the Cooperative, these rules and/or terms shall apply together with these Terms and Conditions and shall be considered special rules in relation to the general rules.
  3. These Terms and Conditions apply to Users of the Cooperative's websites who access them both without registration and in the presence of one or more registrations, where such are required.
  4. These Terms and Conditions also apply to and have a legally binding force upon users of websites maintained and managed by other commercial companies that are one hundred percent owned by the Cooperative.
  5. The terms of use encompass all general terms and policies—regarding personal data protection, the provision of services, unsolicited commercial communications, the use of cookies, intellectual property rights, and the liability for non-compliance with these rules/policies. All of them together govern the relationship between "COOPERATIVE ZASHTITNICITE" and the Users who visit the Cooperative's websites.
    COOPERATIVE "ZASHTITNICITE" is a cooperative registered in the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency under UIC 208103449, with its registered office and management address at: Neofit Rilski Village, Vetrino Municipality, Varna District.   6. The Cooperative shall not be held liable for technical problems that are beyond its sphere of control or are caused by force majeure circumstances. Furthermore, the Cooperative does not guarantee uninterrupted access to the websites of COOPERATIVE ZASHTITNICITE and reserves the right to carry out technical maintenance during time periods of its choice.
  7. The Cooperative assumes no liability in the event that the presence of viruses or other harmful components is detected on the server where the respective website of COOPERATIVE ZASHTITNICITE is hosted.
  8. The Cooperative's websites may include links to external sites provided for the convenience and information of the Users. Users shall use these links at their own risk. The content of external websites is not associated with the Cooperative, which bears no responsibility for their content, regardless of whether it has partner relations with the owners of those websites.
  9. The Cooperative shall not owe compensation for damages to its Users for losses resulting from errors or defects in its use, computer viruses, or theft resulting from the use of the respective website of the Cooperative or a link to another site through it.
  10. The Cooperative has the right at any time and at its own discretion to unilaterally amend the terms and conditions for using its website in the event of legislative changes, the introduction of new rules, the necessity of which has arisen in the practice of the Information Portal, or to increase the quality of the services provided by the Information Portal. All amendments will be published on the Cooperative's website, including on zashtitnicite.bg. They shall enter into force from the moment of their publication, whereby it is assumed that all Users have been informed of the changes. It is the obligation and responsibility of the Users to periodically check for updates to the terms and conditions.
  11. All matters not explicitly settled in these terms and conditions shall be governed in accordance with the applicable legislation of the Republic of Bulgaria. In the event of a dispute, the Bulgarian court shall have competent jurisdiction. In the event that certain clauses of these terms and conditions, applicable to the contracts or applications thereto governing the relationship between the Users and the Cooperative, are or are declared null and void, this shall not affect the validity of the contract in its remaining part or the contract as a whole. The invalid clauses shall be replaced by both parties with other valid ones that correspond to the meaning and purpose of the contractual provisions. If no agreement is reached regarding their content, legal provisions governing similar relationships shall apply by analogy.

II. Services Provided

The Information Portal—the respective website of the Cooperative, including the website zashtitnicite.bg—is designed to provide informational services to its users.

III. Intellectual Property

  1. All intellectual property rights regarding the informational resources, the entire content, and the materials published on the Cooperative's website, including on the zashtitnicite.bg site, are protected under the Copyright and Neighboring Rights Act. Their use without the explicit prior written consent of the Cooperative constitutes an infringement and may lead to civil, administrative, and criminal liability in accordance with the applicable Bulgarian legislation.
  2. The Cooperative grants permission for headlines of materials or portions thereof published on its websites to be republished on other websites, provided that the respective website of the Cooperative is clearly cited as the source and an electronic hyperlink to it is integrated. The electronic hyperlink must be positioned and function in such a manner that it does not mislead third-party users with respect to the Cooperative, does not restrict these users within frames, and does not bind these users to an interface foreign to the Cooperative's websites. Content cited via an RSS feed may not be modified or distributed by any method derivative of the original RSS feed. The Cooperative has the right to terminate access to content provided via the RSS feed at any time without prior notice and without owing any compensation for damages.

IV. Assignment of Rights by the User

  1. By uploading user content (by clicking the "Submit" button or any other button with an analogous function within the respective upload form) that contains objects of copyright, hereinafter referred to as "Work" or "Works," the User grants the Cooperative the right to use the uploaded Works within the regular scope of the Cooperative's activities. This includes the ability of the Cooperative, at its sole discretion and through all technically available means, to integrate the Works into the content of the websites it creates and distributes, making them accessible to an unrestricted number of persons.
  2. The permission granted by the User under Section 1 also encompasses the right of the Cooperative, at its own discretion, not to credit the name of the User in their capacity as the author of the respective Work.
  3. The permission granted by the User pursuant to Section 1 shall be valid for the maximum permissible term specified under the Copyright and Neighboring Rights Act and shall cover the territory of the entire world.
  4. The provisions of these Terms and Conditions regarding the transfer of rights over materials published by the User shall continue to remain in force after the termination of the user's registration.
  5. The User agrees that no remuneration is due to them for the provision of materials and the assignment of rights specified in this section.
  6. By clicking the "Submit" button or any other similar button that uploads content to the website, the User declares and warrants that:
    1. they are the sole author of the provided material or have obtained the consent of all rights holders of the material for its publication on the Cooperative's websites in accordance with these Terms and Conditions. The User has informed the rights holders and obtained their consent to transfer all rights to use the material in favor of the Cooperative. The User undertakes to credit the author of the materials and the holders of copyrights and neighboring rights over objects included in the materials, while agreeing that the final decision to credit the author/holder of the neighboring right rests with the Cooperative;
    2. they bear full responsibility for the content of the published material;
    3. the content of the material does not violate these Terms and Conditions, applicable legislation, or the rights and interests of third parties;

V. Single Point of Contact

The central single point of contact of the Cooperative for communication with the authorities of the Member States, the European Commission, and the European Board for Digital Services, in connection with the implementation of Regulation (EU) 2022/2065 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act), as well as for the recipients of the Cooperative's services, is the following: Email address: [email protected]. VI. Rules Regarding the Reporting of Illegal Content

  1. Any user has the right to submit a notice to the Cooperative regarding illegal content that they believe they have encountered on any part of the Cooperative's websites. This includes, but is not limited to, news and/or other copyrighted content created by the Cooperative's team, as well as content within the comments of other users.
  2. If the User believes that there is illegal content available or content that violates these Terms and Conditions, they may send an email to the address of the Central Single Point of Contact: [email protected]. In the email, it is necessary to complete a Notice explaining the reasons why they consider the content to be illegal or contrary to these Terms and Conditions, where this content can be located (URL), their (the User's) contact details, and a declaration that their statements are true and accurate.
  3. In the event of misuse and upon the frequent submission of notices by a specific User that are clearly unfounded, the Cooperative has the right to suspend the processing of notices from that User.
  4. Every submitted notice regarding illegal content shall be reviewed within 15 business days from the moment of its receipt, and the process shall be carried out by a team comprising a minimum of two employees of the Cooperative. Upon establishing the presence of illegal content, the team shall draw up a protocol detailing the findings and the subsequent measures taken.
  5. Upon the removal of illegal content by the Cooperative as a result of a notice submitted by a User pursuant to Section 2, the User shall receive a notification at the provided electronic contact address.

VII. Rules for Using Comment Sections and Regarding Content Moderation

  1. For the purposes of these Terms and Conditions and in accordance with the requirements of Regulation (EU) 2022/2065 on a Single Market for Digital Services and amending Directive 2000/31/EC (Digital Services Act), as well as in compliance with applicable Bulgarian legislation, "content moderation" represents the entirety of activities, whether automated or not, undertaken by the Cooperative's team aimed at detecting, identifying, and addressing Illegal Content or information incompatible with these Terms and Conditions uploaded in any manner to the websites' content by Users. These measures may include actions affecting the availability, visibility, and accessibility of the illegal content or information, such as reducing visibility, restricting monetization options, blocking access, or removing the content. The measures may also affect the Users' right to publish such information, such as closing or temporarily suspending their profile.
  2. Content moderation is carried out through algorithmic solutions driven by specialized software, according to predetermined criteria for identifying illegal content. These criteria are set by the Cooperative based on the general principles of legality in the Republic of Bulgaria, morality, good practices, and specific restrictions detailed below in these Terms and Conditions.
  3. The Cooperative's team conducts a systematic review and update of the technical condition and functionality of the software under Section 2, as well as the identification criteria under Section 2, no less than once every three months.
  4. When carrying out moderation that results in the deletion of content, the Cooperative shall note in place of the deleted text that it has been removed due to a violation of the Terms and Conditions for using the Cooperative's websites. This notice shall remain visible until the respective comment section is archived or removed from the website for another reason.
  5. Content may also be moderated through human review, whereby the Cooperative's team has the right at any time to remove and/or otherwise restrict the visibility of comments or other user content if they deem it illegal or in violation of the restrictions specified below in these Terms and Conditions.
  6. The Cooperative bears no liability for storage and has no obligation to retain or archive deleted user content in any manner.
  7. The removal of all comments under a given news item along with the news item itself shall not be considered content moderation when it has been completely deleted from the Cooperative's website due to editorial, organizational, operational, or legal reasons.

VIII. Appeal Procedure

  1. If a user notices that their content has been moderated in a manner that they consider unlawful, contrary to these Terms and Conditions, or otherwise affecting their rights, they have the right to submit a Complaint to the address of the Central Single Point of Contact: [email protected]. In the complaint, after providing their full name and telephone number for identification purposes, the user must specify which of their content was moderated and the reasons why they consider the moderation to be unlawful.
  2. Complaints under Section 1 shall be reviewed within 15 business days from the date of their receipt by a designated employee of the Cooperative (hereinafter referred to as the Complaints Officer). In the event of technical complexity, the Complaints Officer shall forward the complaint within a reasonable time to a colleague in the Information Technology department. In cases of legal or factual complexity, the complaint shall be directed for review to an employee of the Cooperative's administration who has been explicitly authorized by the management to rule on such complaints.
  3. The Cooperative shall issue a decision regarding the merits of each submitted Complaint no later than 20 business days after its receipt and shall take appropriate action (for example, restoring the visibility of a wrongfully hidden user comment), and the Complaints Officer shall notify the complainant of the decision and the actions taken in accordance with the requirements of Article 17 of the Digital Services Act - Regulation (EU) 2022/2065.
  4. The complaints specified in Section 1 shall be stored by the Cooperative in an electronic format for a period of 5 years from the date of their receipt, provided that the technical capacity exists to do so (hardware with sufficient memory storage capacity).

IX. Restrictions Regarding Content Shared by Users

1. Within comments, profile data, avatars, and signatures on the Cooperative's websites, users shall not:

1.1. Impersonate other forum participants by copying the name, avatar, or signature of an existing User;
1.2. Impersonate a public figure by using their name or photograph in their profiles;
1.3. Use obscene language, vulgar expressions, insults based on race, sex, ethnicity, or religion, incitement to racial discrimination, ethnic or religious intolerance, sexual discrimination or violence, offensive descriptions of the physical, intellectual, or moral qualities of specific individuals, spam, advertising content, pornographic content, copyright-infringing content, or share any other illegal content.

In the event of a violation of the above rules, the Cooperative has the right to deactivate the accounts of the violators. In case of deactivation, the user may submit a complaint in accordance with the procedure described in Section VIII.

2. Users of the Cooperative's websites have the following rights:

2.1. To share/publish opinions related to the content published on the Cooperative's platforms;
2.2. To reply to already published comments concerning the topic of a specific article;
2.3. To add links to other websites that are relevant to the discussed topic.

3. The Cooperative has the right to hide or delete comments when they include the following:

3.1. Spam or unsolicited commercial communications;
3.2. Comments that are irrelevant to the content of the discussed material;
3.3. Obscene or vulgar language, insults based on race, sex, ethnicity, or religion;
3.4. Incitement to racial, ethnic, or religious discrimination/intolerance, sexual discrimination, or violence;
3.5. Offensive descriptions of the physical, intellectual, or moral qualities of specific individuals, including other participants in the discussion;
3.6. Pornographic content or copyright-infringing materials;
3.7. Personal data protected under the Personal Data Protection Act;
3.8. Content written entirely in a foreign language.

Users who frequently publish content of the aforementioned types may temporarily or permanently lose their right to post comments. The Cooperative has the right to remove existing or newly created accounts suspected of being linked to sanctioned users.

4. The Cooperative shall not:

4.1. Alter the texts within the comments;
4.2. Hide or remove opinions or portions of comments unless they contain the types of content specified in Section 3 or other Illegal Content.

X. Limitation of Liability

  1. Users have the right to use the services provided by the Cooperative's websites, including the website zashtitnicite.bg, solely for personal and non-commercial purposes. The Cooperative makes every effort to maintain accurate, up-to-date, and reliable information on its websites, although occasional discrepancies or omissions may occur. The Cooperative shall not be held liable for any consequences, including potential damages, related in any way to the access, use, or inability to use its websites. All information on the websites is provided in accordance with applicable Bulgarian legislation, without any warranty from the Cooperative regarding its invulnerability and safety from malicious behavior by third parties.
  2. The Cooperative bears no liability for damages resulting from user-published content on any of the Cooperative's websites. The User is obligated to indemnify the Cooperative against any claims, asserted through judicial or extrajudicial proceedings, by third parties, authors, and/or holders of neighboring rights over materials published by the user on any of the Cooperative's websites, and shall fully satisfy any claims asserted against the Cooperative at their own expense. The Cooperative is not liable for subjective perceptions and interpretations of the accuracy, completeness, and usefulness of the informational resources on its websites.
  3. The Cooperative is not responsible for the information (including its completeness and reliability) contained on websites to which the Cooperative's websites provide hyperlinks.
  4. The Cooperative has the right to compensation for all damages, expenses, and third-party claims resulting from a violation of these Terms and Conditions and/or the unauthorized use of the website's services.
  5. If the Cooperative becomes the subject of a lawsuit or other legal action as a result of your behavior or content you have published, we reserve the right to defend or settle the claim at our discretion. Upon our request, you must provide full cooperation in defending against such a claim.
  6. You, as a user, agree to indemnify and hold harmless the Cooperative and our employees, directors, representatives, and licensors from and against any claims, losses, damages, costs, or legal expenses (including reasonable attorneys' fees) arising out of your behavior, your violation of these Terms and Conditions, and/or unauthorized use of the website's services.

XI. Personal Data Protection

  1. The Cooperative is a data controller in accordance with Regulation (EU) 2016/679 and the Bulgarian Personal Data Protection Act. It undertakes to ensure the protection of information containing personal data provided by users online through completed registration forms. Disclosure of this data is possible only when the user has personally filled it into fields designated as public or within the respective form designated as "Settings," as well as when the information is requested by competent state authorities and officials authorized by law to collect personal data, subject to regulatory requirements.
  2. The Cooperative may provide the collected statistical information regarding website traffic to advertisers/advertising agencies that maintain statistics on clicks and other actions of users on their ad banners and links, compile internal statistics, as well as for its own and/or its Partners' direct marketing purposes. By accepting these Terms and Conditions, the User consents to the processing of the personal data provided by them when filling out the registration request for direct marketing purposes. The User has the right to object to the processing of their personal data for direct marketing purposes by sending a written notice to the Cooperative at the following contact address or email: [email protected].

The sending of information regarding changes to the registration conditions or the General Terms and Conditions for using the website shall not be considered direct marketing.

XII. Services Requiring Registration

  1. The Cooperative has the right to require mandatory registration for access to all or specific services. Upon a request to use specific services, the Cooperative may require users to accept additional contractual terms, which shall apply to the relationship between the parties alongside these Terms and Conditions.
  2. Users have the opportunity to obtain free, full access for a specified period from the website owner to the respective sections that require registration, provided they create their own user profile. Within their profile settings, users undertake to provide complete, true, and accurate information, complying with the requirements of these Terms and Conditions.
  3. The Cooperative reserves the right to decide whether to grant a profile/account to a user, as well as to remove or restrict user profiles that it deems unacceptable at its sole discretion, or in the event of reasonable suspicion of a violation of these Terms and Conditions or the applicable legislation within the territory of the Republic of Bulgaria or the EU.
  4. The Cooperative reserves the right to terminate the provision of free services for which no specific deadline has been determined by publishing a notice on the respective website.

XIII. Registration and Identification

The Cooperative identifies the users of the website by storing log files on the website's server or within the database associated with the website.

The Cooperative has the right to collect and use information about users based on and for the purposes of performing this contract, entered into with the user under general terms and conditions. The information by which a user can be identified may include personal data described in these terms and conditions, as well as additional data that the user voluntarily provides upon registration or any other information that the User enters, uses, or provides when utilizing the services and functionalities of the website.

Only individuals aged 18 and older may register on the website. During the registration process, the user confirms their age by checking a checkbox declaring that they are at least 18 years old. The Cooperative shall exercise due diligence to protect the user's information, except in cases of force majeure, accidental events, or malicious acts by third parties.
Within the registration form completed by the User upon registration, the Cooperative indicates the mandatory or voluntary nature of providing the data and the consequences of refusing to provide it.

The Cooperative may disclose personal data to third parties only in cases provided for by law or with the explicit consent of the user.

Registration is carried out by completing the electronic form on the website and expressing consent to the terms and conditions and the privacy policy. Clicking the "Register" button constitutes an electronic statement by which the user confirms that they are familiar with the terms and conditions and the privacy policy, accepts them, and undertakes to comply with them. The Cooperative may store the user's IP address and any other information necessary to identify and reproduce the electronic statement of acceptance of the terms and conditions in the event of a legal dispute. The Terms and Conditions and the Privacy Policy are accessible on the Cooperative's website in a manner that allows for their storage and reproduction.

When completing the registration application, the User is obligated to provide complete and accurate data and to update it within 7 days of any change. The User declares their consent to provide the required personal data, thereby warranting that the data provided during the registration process is true, complete, and accurate, and will promptly update it upon any change. In the event of providing false data, the Cooperative has the right to terminate or suspend the provision of services and the maintenance of the User's registration immediately and without prior notice.

Upon successful registration, the user receives a unique username and password to access the services available via the website. The username does not grant any additional rights other than those specified in the terms and conditions. A person registering in their capacity as a representative of a legal entity is obligated to enter their full name and address, or the name of the legal entity they represent, respectively.

The User is obligated to take all necessary measures to safeguard their password, not to disclose their password to third parties, and to immediately notify the Cooperative in the event of unauthorized access, as well as upon any probability or suspicion thereof. The User bears full responsibility and risk for safeguarding their password, as well as for all actions performed by them or by a third party using their password or carried out through their profile, respectively.

XIV. Rules Upon Termination of Registration

Upon the termination of a User's registration on the Cooperative's websites, the Cooperative has the right to continue using the Works it has deployed within the statutory time limit and subject to the conditions of Section IV.

XV. Amendments to the Terms and Conditions

The Cooperative reserves the right to amend these Terms and Conditions at any time by promptly publishing the changes on the website.

For all matters not settled within these Terms and Conditions, the applicable legislation of the Republic of Bulgaria shall apply.

This privacy policy applies to your use of any products, services, content, features, technologies, or functions, and all related websites, mobile applications, mobile sites, or other online mobile applications offered to you by us (collectively, the "Services").

1. Who We Are

The Data Controller of your data for the purposes of our services is COOPERATIVE "ZASHTITNICITE", a cooperative registered in the Commercial Register and the Register of Non-Profit Legal Entities at the Registry Agency under UIC 208103449, with its registered office and management address at: Neofit Rilski Village, Vetrino Municipality, Varna District, which provides you with our Services in accordance with our Terms and Conditions (hereinafter referred to as "ZASHTITNICITE", "we", "us", or "our" in this privacy policy).

2. What Data We Collect About You

2.1. Data Provided Through Direct Interaction: Registration and Other Account Information

When you register to use our Services, we may collect the following information about you:

  • if you register directly on our platform, you will be asked to provide your email address, first name, last name, and telephone number;
  • if you register using your Google account: first name, last name, email address, and the URL to your Google profile picture;
  • if you register using your Facebook account: first and last name as they appear on your Facebook account, the email address associated with your Facebook account, your Facebook ID, and the URL of your Facebook profile picture. In the event that you have granted permission to Facebook through their in-app privacy option (which appears immediately before you register for our Services), we may collect your gender, age, or email address depending on the permissions granted by you;
  • if you register using your Apple ID account: your first name, last name, and email address; you may choose whether to share your email address with us when logging into your Apple ID account.

Depending on the choices you make during login to our Services or during the process of engaging our Services, you may choose to provide the following additional personal data:

  • your name;
  • email address;
  • mobile number;
  • your payment information, in the event that you wish to use our paid services, which, depending on the payment method used, includes data regarding:
    • your credit/debit card (cardholder name, card expiration date, credit/debit card type, and the last four digits of your credit/debit card number);
    • your mobile number;
    • your email address.

Account Verification

We verify the accounts of ZASHTITNICITE users using Email/SMS confirmation to ensure that each account is linked to a real and unique user. This validation process begins after you initiate the registration process. To confirm your account, we will send you an email to the email address you provided and/or an SMS to a valid mobile number provided by you. This process is completely free of charge. Once your account is verified, you will be able to use our Services and post your comments.

If you do not agree to verify your account, it will remain inactive, and you will not be able to use our Services.

Account validation is performed only once for each account until it is successfully confirmed via Email/SMS by the user.

Once you confirm your account, it will remain linked to the email address used for the Email confirmation and/or the mobile number used for the SMS confirmation. If you wish to change the email address or mobile number associated with your account, you will need to contact our support team.

Communication

Recording of telephone calls with our customers

When you call or choose to be called by one of our customer service representatives, we record the call, provided that you explicitly consent, for the purpose of improving our customer interaction practices.

When you explicitly consent to participate in user interaction studies organized by ZASHTITNICITE from time to time, we will record the interaction with our team. For each study organized by ZASHTITNICITE, we will provide you with specific information regarding how we process your personal data and the purpose for which we do so.

Participation in our user surveys

From time to time, we will provide you with our user surveys to measure your overall satisfaction with the quality of our services. For this purpose, we will only use a session ID (this is a random identifier assigned to you when you download our mobile application or visit our website). In addition, you may choose to provide us with your contact details, such as an email address and mobile number, upon our request to contact you and invite you to attend one of our user experience (UX) tests or an interview with our team. Please note that the information you provide in response to our survey questions may sometimes contain personal data voluntarily provided by you within your answers.

2.2. Information We Collect Automatically When You Use Our Services

When you use our Services, we automatically collect the following information about you:

Device Information

  • We collect device-specific information, such as operating system version and unique identifiers. Examples include the name of the mobile network you use, your IP address, your device's language settings, device brand and type, operating system and version of the device, browser type and version, and information regarding device-specific software, such as fonts, system and browser time zone, and available video and audio formats. If you are logged in, we link these device identifiers to your account.

Location Information

  • Depending on your device permissions, if you post an item within our Services, we automatically collect and process information about your actual location. We use various technologies to determine location, including IP address, GPS, Wi-Fi access points, and cell towers. Your location data allows you to see user items near you and assists you in posting items at your current location. In the event that we require your location data, we will first display a pop-up window asking you to choose whether to allow or deny us access to your location data. If you do not allow us access to your location data, you will still be able to use our Services, but with limited functionality. If you do grant us access to your location data, you can always change this later by accessing the settings of our website or mobile application and disabling the permissions related to location sharing. Customer and Log Data

  • Technical details, including your device's Internet Protocol (IP) address, time zone, and operating system. We will also store your login information (date of registration, date of last password change, date of last successful login), as well as your browser type and version.

Clickstream Data

  • We collect information about your activity within our Services, which includes the websites from which you accessed our Services, the date and time stamp of each visit, searches you performed, advertisement listings or ad banners you clicked on, your interaction with such advertisements or ad listings, the duration of your visit, and the order in which you access content within our services.

We use cookies to manage our users' sessions, store your preferred language selection, and provide you with relevant advertisements. "Cookies" are small text files transferred from a web server to your device's hard drive.   1. if you register using your Google account: we receive the email address associated with your Google account (to create your account and send you system notifications and marketing communications), your Google ID, and your full name (used as your username when you use our Services), as well as the URL of your profile picture (to create a profile picture for your ZASHTITNICITE account);
  2. if you register using your Facebook account: we receive the email address associated with your Facebook account (to create your account and send you system notifications and marketing communications) and information from your public profile, including your Facebook ID, first name, and last name (used as your username when you use our Services), as well as the URL of your Facebook profile picture (to create a profile picture for your ZASHTITNICITE account);
  3. certain technical and usage information from analytics providers, such as Google Analytics 360, for statistical purposes and to analyze the usage of our Services, improve our Services, and for online marketing;
  4. if you choose to store your payment card details with us: we receive the following card-related data from our payment partners, such as ePay: first and last name, card expiration date, and the last four digits of the card number;
  5. public authorities provide us with a username, telephone number, and email address when they request ZASHTITNICITE to conduct verifications or provide these authorities with more data in the context of fraud prevention activities.

3. Do We Collect Data from Children?

Our services are not intended for individuals under the age of 18, and we do not knowingly collect data from individuals under 18. If we become aware that a person under the age of 18 has provided us with personal data, we will delete it immediately.

4. Why Do We Process Your Personal Information?

We will use your personal data only when the law allows us to. Most commonly, we will use your personal data under the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you.

  1. If you log in using your mobile number or email ID, we use your first and last name, mobile number, and/or email address to identify you as a user and to grant access to our services.
  2. If you log in using your Facebook account, Google account, or Apple ID account, we use your first and last name and your email address associated with that account, as well as the URL of your profile picture (except when you use an Apple ID account), to identify you as a user of our services and to grant you access to our Services. The aforementioned login data is also used by us to deliver our Services to you in accordance with our Terms of Use.
  3. We use third-party payment service providers to process any payment you make for our Services. Depending on the payment method, you may be asked to provide us with your payment and credit card details, which we will then provide to the payment service provider to process your payment. We do not store your credit card information unless you choose the option to save such information to facilitate recurring payments without having to re-enter your details each time. In such cases, we only store your cardholder name, card expiration date, card type, and the last four digits of the card number. We do not store any credit card verification code values (CVV) and simply forward such values and your credit card number in an encrypted manner for the purpose of processing your payment by our payment service provider.

4.2. For Improving Your Experience with Our Services

  1. We use clickstream data to:
    • offer you tailored content, such as providing you with more relevant search results when you use our services;
    • determine how much time you spend on our services and how you navigate through our services in order to understand your interests.

      For example, we may provide you with suggestions for content you can visit based on the content you have clicked on.

  2. If you choose to provide us with your location data, we use your location data for the following purposes:
    • to compile anonymous and aggregated information regarding the characteristics and behavior of ZASHTITNICITE users, including for the purposes of business analysis, segmentation, and the development of anonymous profiles;
    • to improve the performance of our Services and to personalize the content we target toward you. For example, using location data, we display advertisement listings that are near you or news/article information within the area of your location;
    • for this purpose, the Google Maps service is integrated into our Services. Google Maps is provided by us and Google, acting as independent controllers.     To display and recommend listings of advertisements/news/articles within our Services that may be of interest to you, we deploy algorithms that utilize information related to your browsing behavior, clickstream data, your user ID, and your location data, provided you have granted us permission to use it. We use this form of automated decision-making based on our legitimate interest in improving our Services and providing a better user experience by offering you more relevant ad listings/news/articles.

  5. By consistently utilizing your session ID (a random identifier assigned to you when you download our mobile application or visit our website), from time to time we will provide you with user surveys designed to determine your satisfaction with the quality of our services. When providing you with a survey, we may also request your email or mobile number in order to contact you and invite you to attend one of our user experience (UX) tests or an interview with our team.

We process the above information for the adequate performance of our contract with you and based on our legitimate interest to improve your experience with our services.

4.3. To Provide You with Safe and Secure Services

  1. We use your mobile number, log data, and unique device identifiers to administer and protect our services (including troubleshooting, data analysis, testing, fraud prevention, system maintenance, support, reporting, and data hosting).
  2. We collect certain information from and in relation to the electronic device through which you access our Services, based on our legitimate interest in preventing fraud within our Services. The information we collect includes your user ID (depending on whether you are logged in), the ZASHTITNICITE country domain, IP address, device language settings, device brand and type, operating system and version of the device, browser type and version, and information regarding device-specific software such as fonts, system and browser time zone, and available video and audio formats. This device-related information is used to determine whether the same device is being used when users interact with our Services.   1. We use your email address and mobile number (via SMS or Viber) to make offers and recommendations regarding our services that may interest you.
  2. To send you email messages with offers and recommendations regarding advertisement listings or our Services, we deploy algorithms that utilize information based on your clickstream data. We will always provide you with the option to opt out of such communications by including an unsubscribe link. We use this form of automated decision-making based on our legitimate interest in improving our Services, increasing the number of transactions within our Services, and ensuring a better user experience by offering you more relevant ad listings.
  3. We use clickstream data to monitor and report the effectiveness of campaign delivery to our business partners and for internal business analysis.
  4. If you choose to provide us with your location data, we may use your location data to measure and monitor your interaction with third-party advertising banners that we place within our services.

10. Where Do We Store Your Data and for How Long?

The data we collect about you will be stored and processed both within the EEA and on secure servers to ensure the best possible user experience, for example, for fast loading/rendering of the website or mobile application.

We will retain your personal data only for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, tax, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

We store the personal data associated with your account for as long as you are a registered user or until you delete your account, in which case we will ensure that your data is deleted without undue delay and as soon as possible, when technically feasible. Depending on the Service you have used and the systems in which your data is stored, the deletion of your data may take a maximum of 3 months from the date of your request. During this period, all access to your data will be restricted or blocked immediately.

If there has been no activity in your account for a period longer than 24 months, we will close your account and delete all personal data stored within it, meaning you will no longer be able to access and use it.
